Terms of Service
Please read these terms carefully before using the EmployAIQ platform.
These Terms of Service ("Terms") govern your access to and use of the EmployAIQ platform ("Service"), operated by AIToken Labs ("we," "us," or "our"). By accessing or using EmployAIQ, you agree to be bound by these Terms.
EmployAIQ is an AI-powered business communications platform that enables small businesses to automate customer communications including appointment scheduling, SMS notifications, voice interactions, and customer support responses.
You must be at least 18 years of age and have the legal authority to enter into these Terms on behalf of yourself or your business. By using EmployAIQ, you represent that you meet these requirements.
When you register a business account on EmployAIQ, you are responsible for:
- Providing accurate and complete business information
- Maintaining the security of your account credentials
- All activity that occurs under your account
- Ensuring your use of the platform complies with all applicable laws
By using EmployAIQ's SMS features, you agree to:
- Only send messages to end users who have provided explicit written consent
- Honor all opt-out requests immediately (STOP keyword)
- Comply with the Telephone Consumer Protection Act (TCPA), CTIA guidelines, and all applicable carrier regulations
- Not use the platform to send spam, unsolicited messages, or any content that violates carrier policies
- Maintain records of end user consent
Violation of these terms may result in immediate suspension of your account and reporting to relevant authorities or carriers.
You agree not to use EmployAIQ to:
- Send illegal, fraudulent, or deceptive communications
- Harass, threaten, or harm any individual
- Transmit malware, viruses, or malicious code
- Violate any applicable local, state, national, or international law
- Infringe on the intellectual property rights of any third party
- Impersonate any person or entity
We strive to maintain high availability of the EmployAIQ platform but do not guarantee uninterrupted access. We reserve the right to perform maintenance, updates, or modifications at any time. We will make reasonable efforts to notify users of planned downtime.
EmployAIQ operates on a subscription or usage-based model. By providing billing information, you authorize us to charge applicable fees. All fees are non-refundable unless otherwise stated. We reserve the right to modify pricing with reasonable advance notice.
All content, features, and functionality of the EmployAIQ platform — including but not limited to software, design, logos, and trademarks — are the exclusive property of AIToken Labs and are protected by applicable intellectual property laws. You may not copy, modify, or distribute any part of the platform without our express written consent.
EmployAIQ integrates with third-party services including Twilio (SMS/voice), OpenAI (AI capabilities), and others. Your use of these integrations is also subject to those providers' terms of service. We are not responsible for the actions or policies of third-party providers.
To the maximum extent permitted by law, AIToken Labs shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of or inability to use the EmployAIQ platform. Our total liability to you for any claim shall not exceed the amount you paid us in the three months preceding the claim.
You agree to indemnify and hold harmless AIToken Labs, its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including reasonable legal fees) arising from your use of the platform, your violation of these Terms, or your violation of any third party's rights.
We reserve the right to suspend or terminate your account at any time for violation of these Terms, illegal activity, or any conduct we determine to be harmful to the platform, other users, or third parties. You may terminate your account at any time by contacting support@employaiq.com.
These Terms shall be governed by and construed in accordance with the laws of the State of Maryland, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts located in Maryland.
We reserve the right to modify these Terms at any time. Material changes will be communicated via email or a prominent notice on the platform. Continued use of the platform after changes take effect constitutes acceptance of the revised Terms.
